(user) undertakes to use the same with the bugs. In case of
incompatibility with any other computer software or hardware,
licencee (user) alone will be responsible to correct /
rectify compatibility issue. Judgments online shall not be
responsible for this.

copy-edited text of the judgments, Headnotes, short notes.
Equivalents, comments on cases referred, references and
footnotes are copyrighted material. Any copying in any manner
including storage in any retrieval system, or transmission by
any means or use of various files in any form without written
permission of M/S INSTANT LAWNET REPORTS / JUDGMENTS ONLINE,
CHANDIGARH will entail civil and criminal action. Use of files
& software in any other form or format is prohibited.
LICENCE / USAGE
AGREEMENT

This is a licensed program not
a sale. Judgments Online / instant Lawnet Reports grants
non exclusive and non transferable licence to use
Software, Database and other files etc. subject to
following conditions. Software, Database(s) and other files
etc. are exclusive property of Judgments Online / Instant
Lawnet Reports or its associates/Licensors etc.. It is
protected by Indian and International Trademark, Copyright,
Patent, Information Technology and other
Laws.

In addition to
the restrictions and obligations imposed by various laws
within India and also by International Laws, Licencee agrees
to comply with the following conditions.

In case of use
of this Program by a person other than a licensee or at the
behest of the licensee or otherwise or in contravention to
any condition of the license, license shall stand cancelled
with immediate effect.

License is for single computer
and single user. Public use is prohibited. Demonstration or
use by person other then licensee is prohibited. Giving
on lease or rent etc. is not permissible. Use on
Network(s), BBS or Internet etc. is not permissible.

Licensee shall use the software in
machine readable form
only. Database will be read / used through software provided
for it by Judgments Online only.

Licensee shall not
make copy of software on any type of media. License shall
terminate with destruction of original CD or after one time
use/installation if loaded from Internet.

Licensee shall not cause or permit the
reverse compilation
/ disassembly / modification / translation / decompilation / patching
of the data or text or software or
activation key or any thing provided by Judgments Online.

Licensee shall not
cause or permit the removal of any proprietary notice(s),
label(s), or mark(s) etc. on the software, database,
documentation, or CD cover or any packaging accompanying
Software.

Licensee shall not add or delete any
file, text or part
of this software / Database / files nor shall allow any other
person to add or delete any file, text or part of this
software / Database / files .

Licensee may
transfer the software on permanent basis with prior written
permission of Instant Lawnet Reports as per conditions
stated in permission provided :

a) the recipient must
also agree to the terms and conditions of this
License

b) and
licensee destroys any and all copies of the software in
licensee's possession. Such transfer shall not be
outside India.

Licensee shall
not disclose the results of performance/benchmark tests run
on the software without the written consent of Instant
Lawnet Reports.

Licensee shall not make copy
of the software, data or CD in any manner.

Updating is not
part of this Licensed Product. Mode of updating if any shall
be in the manner prescribed by Instant Lawnet Reports from
time to time and at the cost of licensee. Updating shall be
from B.B.S. or from INTERNET SITE OF ILR. Updating of data
& software shall be at the cost of licensee to be
provided at Chandigarh. Equipment or software's used for
updating shall be of licensee. It may be subscription
based.

Frequency of
updating if any shall differ or vary in the manner
prescribed by Instant Lawnet Reports from time to
time.

Warranty - this license carries limited warranty, ILR undertakes to refund or repair or replace defective CD against manufacturing defect if same is reported within Sixty days of purchase by a registered letter before taking Authorisation Code / Activation Key. Decision of Judgments Online shall be binding and final. Once
activation Key has been taken no replacement would
be permissible. Taking of Authorisation Code means satisfaction of
warranty.

Maximum liability of Judgments
online / Instant Lawnet Report shall in no case
would be more than amount paid by Licencee to Judgments
Online.

Judgments
online / Instant Lawnet Report does not represent that the
functions contained in the software will meet users
requirements or that the operation of the software will be
uninterrupted or error free.

Bugs and / or
incompatibility with other computer software or hardware may
arise. Licence is on as it is basis. Judgments online will
not be responsible for removing any bug in software, Licence
undertakes to use the same with the bugs. In case of
incompatibility with any other computer software or
hardware, licencee alone will be responsible to correct /
rectify compatibility issue. Judgments online shall not be
responsible for this.

In no event shall Judgments Online / Instant Lawnet Reports or
anyone else who has been involved in the creation, production,
or delivery of the
SOFTWARE / Databases be liable for any special,
incidental, indirect, or consequential damages whatsoever (including, without limitation, damages for
loss of business profits, business interruption, loss of business information,
or any other pecuniary loss) arising out of the use of
or inability to use the Software /
Database / files, even if Judgments Online / Instant
Lawnet Reports has been advised of the possibility
of such damages.

Free CD or
Download versions are totally free from Warranty / liability
of any kind.

In case of any
dispute courts at Chandigarh alone would have jurisdiction.

Download or use
of CD, Software, Data etc. will be at the risk of User. User
must keep proper backup of his files loaded on computer in
order to prevent data loss. Publishers, owners, editors
& developers or any other persons associated with this
project are not responsible for any loss or damage occurring
due to any virus or by use of this software in any manner or
loss of any data or damage to other software / hardware.

These conditions supersedes all other
communications, advertisements, or understandings given by
Judgments Online or on its behalf. In case user does not
agree
or have objection to any
of the conditions then he can return
the CD (before its use) to the Judgments Online along with all
its packaging and original Bill or invoice for refund of amount paid
by it. In case it is not purchased from Judgments Online
then return should be through the person from whom it
has been purchased. Use of CD in any manner (Installation etc. with
or without activation Key / Authorisation Key) would mean
that User has read this agreement and has and has agreed to
abide by it. Since Activation Key / Auth. Code is taken
after installation - taking of Activation Key /
Authorisation Code would mean that CD is free from any
Defect and warranty is satisfied / complied with. User must
check and satisfy himself about any physical damage which
can be seen by eyes before installation.

Help or support
shall be at the cost of user and would be on telephone or by
email only (expences of which would be borne by user).
Judgments Online shall not provide onsite support or help
under any circumstances.
SALE / SELLING
CONDITIONS
-
Payment of money by any mode would only entitle the person making the payment for grant of non exclusive and non transferable licence at the discretion of Instant Lawnet Reports / Judgments Online. Grant of Licence is discretion of ILR and can be refused even after acceptance of money. In case of refusal amount paid will be returned after deducting 8 % in case of Credit card payment and 5 % in case on internet account transfer. ILR does not accept cash payments
except at its sales office at Chandigarh. payment of
cash to any person (except at sale counter at
Chandigarh against proper receipt issued by ILR only)
is not acceptable and any such payment shall be at
your risk and ILR shall not be responsible for same.
Cheque and Drafts must be a/c
payee in the name of Instant Lawnet
Reports and payable at Chandigarh only. Only local cheques are acceptable.

In case of any dispute courts at Chandigarh alone would have jurisdiction.

Payment on net through Credit card or account transfer would be at your risk. ILR shall not be responsible for any kind of loss DIRECT OR INDIRECT OR COLLATERAL OR INCIDENTAL ON ACCOUNT OF SAID TRANSACTION.

Grant of Licence would be subject to DISCLAIMER, LICENCE / USAGE CONDITIONS and COPYRIGHTS.

Payment of money would mean that User has read Licence agreement, Sale conditions, Disclaimer and Copyright conditions and has agreed to abide by them.

Help or support shall be through e-mail or Telephone at your cost. In no circumstance it would be onsite.

No claim of refund or return would be entertained after activation code is sent to user. In case activation code does not work user undertakes to abide by instructions of ILR for correcting the error. In case error is at users end user alone would rectify and ILR shall not be responsible for correcting the same.
